BuildSynergy is a South African digital services business providing website design, website development, managed hosting, lead capture setup, SEO basics, AI development and integration, website care, maintenance and related digital services.
This Privacy Policy is prepared with reference to the Protection of Personal Information Act 4 of 2013 (POPIA).
"BuildSynergy", "we", "us" or "our" means BuildSynergy. "Client", "you" or "your" means any person, business, visitor, supplier, contractor or user who interacts with us. "Personal information" means information relating to an identifiable person or, where applicable, an identifiable juristic person.
By using our website, submitting information to us, accepting a quotation, or using our services, you acknowledge that you have read and understood this Privacy Policy.
You may only provide us with your own personal information, or the personal information of another person where you have permission or legal authority to do so.
We do not intentionally collect special personal information unless it is necessary for a specific lawful purpose and the required consent or authority has been provided.

BuildSynergy delivers managed hosting and related services using third-party infrastructure providers which may include Vercel and Hostinger (hosting and deployment), Neon (database), Resend (email) and other technology partners. These providers may process or store information according to their own terms, privacy policies and security practices. BuildSynergy will take reasonable steps to use reputable providers, but we are not responsible for the independent data handling practices, outages, policy changes, security failures or service interruptions of third-party providers outside our control.
Some of our services involve building and operating AI solutions. To do this, we and our clients use third-party AI providers (which may include OpenAI and Anthropic) and hosting platforms (which may include Vercel). Where you interact with an AI feature we have built, or where we process data to deliver an AI solution, that data may be sent to these providers and processed outside South Africa. On their standard business (API) terms, these providers do not use submitted data to train their models. We use reputable providers and rely on their security and data-protection commitments, but we are not responsible for their independent practices.
Where BuildSynergy manages a Client website, contact forms, analytics tools or hosting environment, personal information submitted by visitors to that Client website may be processed through the relevant systems. In this case we act as an operator processing personal information on the Client's behalf and on their instructions. The Client remains the responsible party for the personal information of their own customers and end-users, and for ensuring that their own website content, privacy notices, business terms and customer data practices comply with applicable laws.
We take reasonable technical and organisational measures to protect personal information against loss, misuse, unauthorised access, disclosure, alteration or destruction, including access controls, password protection, secure hosting environments, backups, software updates and limited access to information. No electronic system is completely secure and we cannot guarantee absolute security.
If we become aware of a confirmed or reasonably suspected security compromise involving personal information under our responsibility, we will take reasonable steps to investigate, contain and respond to the incident. Where required by POPIA, BuildSynergy will notify the Information Regulator and affected data subjects.
We keep personal information only for as long as necessary for the purpose for which it was collected, or as required by law. As a guide: enquiry and prospect information is kept for up to 12 months after last contact; client project and account records, including invoices, are kept for at least 5 years to meet tax and legal obligations; and hosted client data is dealt with as set out in our Terms and Conditions. When information is no longer required, we delete, destroy or anonymise it where reasonably possible.
Subject to applicable law, you may have the right to request access to, correction of, or deletion of personal information we hold about you; object to certain processing; withdraw consent; request restriction of processing; and lodge a complaint with the Information Regulator. To exercise your rights, contact our Information Officer using the details below. We will respond within a reasonable period and, in any event, within 30 days where practicable. We may need to verify your identity before processing your request.
We may send marketing communications where you have opted in, where you are an existing Client, or where permitted by law. You may unsubscribe at any time. We will not sell your contact details to third parties for marketing purposes.
Our services are intended for businesses and adults. We do not knowingly collect personal information from children without the required consent of a parent, guardian or legally authorised person.
Some of our third-party providers store or process information outside South Africa, including in the United States and the European Union. Where we transfer personal information across borders, we do so on a basis permitted by section 72 of POPIA — for example, because the recipient is subject to laws or binding agreements that provide adequate protection, the transfer is necessary to perform our contract with you, or you have consented. By using our services, you acknowledge that cross-border processing is necessary for hosting, cloud services, AI services, analytics, email services, domain services and related digital tools.
